Inheriting is allowed; moving the money has rules
For a non-resident Indian, inheriting assets in India is generally straightforward in principle — an NRI can inherit bank balances, securities and property from a relative in India much as a resident would. The part that has its own rules is what happens next: bringing the proceeds abroad, which falls under the Foreign Exchange Management Act (FEMA) and the RBI's remittance-of-assets framework.
So there are really two questions to keep separate: establishing the inheritance in India, and then repatriating it. Confusing the two is what makes NRI inheritance feel harder than it is.
Establishing the claim in India
The claim itself works the same way it does for a resident. Where the deceased left a nomination or a surviving joint holder, the institution releases the balance on the usual documents. Where there was no will and no nomination, the family may need a succession certificate; where there was a will, probate may be involved. Our guides on claiming a bank account and on succession certificates cover both routes.
For property, inheritance is generally permitted, and how the title passes follows the same succession law that applies to any heir — see our guide on property inheritance in India.
The NRO account is the hub
In practice, inherited money in India is generally routed through a Non-Resident Ordinary (NRO) account. Rupee income and inherited proceeds sit in the NRO account, and repatriation abroad is done from there within the FEMA limits and with the documentation an authorised dealer bank asks for.
Because the mechanics run through the bank, the practical step is to open or use an NRO account and ask the authorised dealer what it needs for an inheritance credit and a subsequent remittance.
Repatriating the proceeds under FEMA
The RBI's remittance-of-assets rules allow a non-resident to remit inherited assets abroad, subject to an annual overall limit for such remittances and to producing documentary evidence of the inheritance to the bank, with a tax clearance or the prescribed certificate from a chartered accountant. Some cases fall within what the bank can process directly; others require prior RBI approval.
Because the annual limit and the exact paperwork are set by FEMA and revised from time to time, confirm the current threshold and document list with your authorised dealer bank and the RBI's remittance-of-assets material rather than relying on a figure from elsewhere.
Where NRIs get caught out
The common surprises are procedural: assuming inherited money can be sent abroad from any account rather than through an NRO account; underestimating the tax certificate the bank asks for before remitting; and not realising that succession law and the personal law that applies still govern who inherits, exactly as for a resident.
The way to make it painless is preparation on the Indian side — nominations kept current, a findable record of what exists and where, and a will that is consistent with all of it — so that a family living abroad is not managing an Indian court process by email.
大家常问的问题
- Can an NRI inherit property and money in India?
- Generally yes — an NRI can inherit bank balances, securities and immovable property from a relative in India. Establishing the inheritance works much as it does for a resident; the distinct part is repatriating the proceeds abroad under FEMA.
- How does an NRI move inherited money abroad?
- Inherited funds are generally routed through an NRO account and remitted from there under the RBI's remittance-of-assets rules, within an annual limit and with evidence of the inheritance and a tax certificate. Some cases need prior RBI approval — confirm the current rules with your bank.
- Do I need a succession certificate as an NRI?
- Only in the same situations a resident would — mainly where there was no nominee and no survivor and the amount is above what the institution settles on an indemnity. Where a nomination or survivorship exists, it is usually not required.
